This page contains information regarding terms and conditions for The Big Egg Hunt auction site, The Big Egg Hunt competition, The Big Egg Hunt privacy policy and The Big Egg Hunt Terms of use.

The Big Egg Hunt Auction

Our auction website has our full auction terms and conditions.

The Big Egg Hunt Competition Terms

  1. The competition
    Over 200 uniquely crafted eggs created by leading artists, designers, architects and jewellers will be displayed in central London as part of the Big Egg Hunt. Join the hunt for the unique SMS keywords (“Keywords”) displayed on these eggs and for each correct Keyword you submit you will be entered into a draw for a chance to win the Fabergé Diamond Jubilee Golden Egg.
  2. To enter
    On each Egg, a unique Keyword can be found. The start date for the competition is 21st February 2012. To enter the Hunt with your first egg, text the Keyword to 80001. It costs £3 to enter the Hunt, plus 25p per additional egg code you collect, plus your standard network rate for each text. Please get permission from the bill-payer before texting.

    Alternatively, you may submit the Keyword for free, plus your mobile number, by post to the following address: The Big Egg Hunt Competition; c/o Action for Children, 10 Great Queen Street, London, WC2B 5DG. Entries without a contact number will be invalid.

    You may only enter one entry per egg, whether by text or post, with the exception of the Wally Egg (see below).

    Each egg Keyword you enter will be added as a separate entry to the prize draw. Further entries will not be counted but may still be charged.

    Entries must be texted or reach the Egg Hunt address specified above no later than Tuesday, 3rd April at 23.59 GMT. Entries received after this date and time will not be counted but may still be charged.

    By submitting their entry entrants will be deemed to have agreed to be bound by these rules. Entries through agents or third parties will be invalid.

    SMS bounceback messages may be received from two numbers – 80001 (for £3) and 83080 (for 25p). Both of these numbers may show on phone bills.

  3. Where’s Wally
    Just like all the eggs in the Big Egg Hunt, Wally has his own code word you can use to enter the prize draw for the fabulous Golden Egg. However, the Wally Egg is a bit special, as his code word gives you two entries into the prize draw, rather than the usual one.

    And that’s not all: each time Wally moves to a new location on his London adventure, his code word changes – giving any lucky Wally Watchers another two entries to the prize draw.
     

  4. Selection of the winner
    The winning entry will be drawn at random from all valid entries by an independent judge on Thursday, 5 April 2012. The winner will be announced online in the week commencing Monday, 9 April 2012 and the winner will be notified by phone as soon as practicable either before or after this date. If a winner cannot be contacted within 21 days of the draw, the Promoters reserve the right at its absolute discretion to withdraw prize entitlement and award the prize to a substitute winner drawn at the same time as the original. The judge’s decision is final and no correspondence will be entered into.
  5. Eligibility
    Entrants to the competition must be 18 years or over on 21st February 2012 and texts must be sent from a UK mobile number. Entry is prohibited to those who at any time between the Start Date and the date on which the winner is selected (inclusive) are employees of Action for Children and/or the Elephant Family (the “Promoters”), any of their wholly owned subsidiaries or any marketing services agency or other company involved directly with the administration of this competition, or any member of their households.
     
  6. Validity
    There is a limit of one entry per mobile number per egg. To be valid, each entry must contain the correct egg Keyword.

    Only original entries will be considered valid. Responsibility cannot be accepted for incomplete entries or entries lost, damaged or delayed in transit to the address at Rule 2. Messages have to be safely received and the bounce back delivered to the handset for an entry to be counted. Proof of posting will not be accepted as proof of receipt. It is the Promoters’ discretion to accept some common misspellings of egg Keywords. Correspondence will be entered into only at the absolute discretion of the Promoters.
     

  7. The prize
    The prize is ‘The Fabergé Diamond Jubilee Egg’, an 18 carat gold egg, encrusted with 60 fine gems and with estimated value of over £100,000. The prize is non-transferable and there is no cash alternative for the prize. At the Promoters’ discretion another prize of equivalent or greater value may be substituted if in all reasonable circumstances the Promoters are unable to offer the intended prize.
     
  8. Promoters discretion
    The Promoters retain sole discretion to withhold the prize without liability if in their view the winner is ineligible, the entry is invalid or the winner does not meet the necessary requirements as set out in these terms and conditions. The Promoters reserve the right to withdraw or amend the promotion in the event of unforeseen circumstances or circumstances outside of their control.
     
  9. Does the charity receive my money?
    For each 25p text the Promoters will receive at least 10.3p between them, depending on the network provider. For each £3 initial entry the Promoters will receive at least £1.72 between them, depending on the network provider. This money will be divided equally between Action for Children and Elephant Family.
     
  10. Winner publicity
    Entrants accept that, if they win, the Promoters will have the right, without additional payment or permission, to use their name, age, town of residence and likeness for the purposes of announcing the winner of this competition and for related promotional purposes.
     
  11. Winning entry details
    The name of the winner and the winning entry will be sent to anyone who writes within 3 months after the closing date, enclosing a stamped addressed envelope, to the address in Rule 2 above, requesting details of the winning entry.
  12. Data privacy
    The Promoters would like to keep entrants informed of the Promoters’ similar competitions and charitable activities by telephone and/or text message. Please write to the Promoters at the address in Rule 2 if you specifically do not want to receive this information, or text STOP to 80001.
     
  13. The Promoter
    The Promoters are Action for Children, of 3 The Boulevard, Ascot Road, Watford WD18 8AG and Elephant Family, of 17-18 Hayward Place, London, EX1R 0EQ. Please do not send entries to these addresses. If you have any questions relating to this promotion please contact the Customer Service number 01923 361688.
     
  14. Liability
    The Promotion and these rules are governed by English law and are subject to the exclusive jurisdiction of the English courts. To the extent permitted by law, the Promoters exclude all liability whatsoever to entrants and the winner in relation to the promotion and the prize to be awarded. Please retain a copy of these rules for your reference.
     

The Big Egg Hunt Privacy Policy

The Big Egg Hunt is a joint initiative of two charities: Action for Children and Elephant Family. When you provide information to The Big Egg Hunt website or auction, the information will be managed by Action for Children, on behalf of both organisations. Either organisation may communicate with you and send you updates about The Big Egg Hunt and their work to help make a real difference around the world.

Both charities are committed to protecting and respecting your privacy, and take your data security very seriously. How we deal with your data, what we ask of you and what we do with it in the future are all covered in this privacy policy. And we make sure we do everything in accordance with the Data Protection Act 1998 which is the law protecting your information. Through the law, we are obliged to only collect certain information, look after it securely and let you know how we plan to use it. We are also happy to let you know what personal data or information we keep which relates to you.

Any changes we make to this privacy policy will be posted on this page, so please check back from time to time.

What might we collect?

Since The Big Egg Hunt is a campaign which includes a lot of fantastic things happening around London throughout the spring, we want to be able to keep you in touch with the latest information, through our newsletter. Also you can bid to own one of the Eggs, so we’d need to register you to take part in the online auction. You may also want to contact us, or ask a question about The Big Egg Hunt. When you do get involved in those ways, The Big Egg Hunt will receive personal information about you, such as your name, your email address and details of where you live.

We will only collect the necessary information and never ask for things without a good reason. You can of course also choose not to receive emails from us at any time by unsubscribing from them, or writing to us to remove your details from our database. More on that can be found below.

To help make your visit to The Big Egg Hunt site more eggsciting we will be making use of cookies to help with the process of logging you in and out of the site and connected sites like Facebook for example. We have covered more details about them later on in the ‘Cookies’ and ‘How We Use Your Information’ sections. Which brings us on to:

How we use your information:

Since the campaign is quite focused on Eggs and the work of Action for Children and Elephant Family, we will only use your information to help keep you up to date about the Hunt or the Auction, and to give you a better sense of the impact of your support through the two charities.

Once The Big Egg Hunt is over, your support and any donations or Auction payments will help to make a world of difference to children and the endangered Asian elephants. In order to make sure we do the best job we can, cost effectively, of keeping you informed about your contribution, we may contact you with updates and let you know of other great things which each charity is organising.

If you bid on the Auction and win the Egg of your dreams, we will of course also be in touch to arrange payment and then delivery of your new beautiful Egg. During the process of sorting out the payment, we may take credit or debit card details from you and we will detail how we use them a little later.

We are also running an amazing text competition for the chance to win a fabulous Egg from Fabergé – The Diamond Jubilee Egg worth over £100,000. You can find out all about how we will manage any of your data if you enter the competition by looking at the terms for that competition here. When you get in touch with us with a question or complaint or to learn more about how to be involved with The Big Egg Hunt, we will use your details in order to let us contact you or reply to your query.

We use a system called “opting in” to receive contact from us. This means we’ll only send you things like emails or other exciting bits and pieces if you have specifically opted in to receive them from us. In the case of The Big Egg Hunt, either Action for Children or Elephant Family may share information and updates with you. As mentioned earlier, if you change your mind and would like to opt out at any time, you can do so by using the unsubscribe link in all our emails, or by contacting us.

Just to be super clear, we also keep anonymous data about visits to The Big Egg Hunt site too, and use simple tools like Google Analytics to chew through all these statistics and make sense of them. This helps us to make your time on the site more effective and more exciting. But, the important part, none of these aggregated statistics include any information which can identify you or any of the other users of the site. It is just geeky stuff which helps us see which buttons work better, and which parts of the site are more interesting.

Sharing or disclosing your information:

We will keep your personal information securely and treat all of it confidentially. We will not supply it to any third party without your consent, unless we are obliged or permitted by law to do it.

We do sometimes use third parties to process your information on our behalf (for example to take payments for Auction bids, to make all the clever SMS stuff happen with the text competition or when we send out emails).

However, we have a contract with them and this requires them to keep your information secure and not to use it for their own business purposes.

Sometimes we keep a back-up of your data, or we host parts of our site, using equipment or servers which may be located outside Europe, such as in the U.S.A. We do this to make sure we don’t lose your information if there are any technical hitches in the EU, and because often this is the most cost effective way or the services supplied by these companies are the best in the world. By providing personal information to us, you consent to your information being processed on our behalf in these countries.

When you share personal information with The Big Egg Hunt, you consent that either Action for Children or Elephant Family may transfer your information within their offices or regional companies as necessary to make sure they give you the best experience possible. You also consent to allow your personal information to be transferred to a third party in the event of a reorganisation or merger of either Action for Children or Elephant Family; you would be notified ahead of the merger or change, and you would be given clear details of how you could opt out or unsubscribe if you would prefer.

Cookies:

Cookies are not just tasty treats and clever ways to make your trousers appear to shrink. They are also little bits of code which keep tiny pieces of information sent from our website to your computer, funky tablet device or smart phone. They help us make your visit to the site more exciting and effective and enable us to identify you quickly. They also help us gather information about how the site is used, although this is the anonymous statistical stuff we mentioned earlier.

Unless you have set up the browser on your desktop or tablet or phone so it will refuse cookies, The Big Egg Hunt site will issue cookies when you log in to collect Eggs, or register to place bids on the Auction site. Children:

If you are under 16, please make sure you have your parent or guardian’s permission before you provide any personal information to us. Children under 16 must not provide us with personal information without this permission. Unfortunately we cannot accept entries to the Big Egg Hunt text competition and auction from those under the age of 18.

Other eggs-citing websites:

The Big Egg Hunt site contains links out to lots of rather lovely third party websites like twitter, Facebook, Fabergé, Action for Children and Elephant Family. This privacy policy only applies to the main Big Egg Hunt site and our Auction pages, so if you follow a link to a third party site, please make sure you read the privacy policy on that site. We do not accept any responsibility for the content on third party sites, nor can we be responsible for how they will collect and use your information, so make sure you check out their terms or policy sections.

We’re glad you stopped by on your virtual travels and came to see us. We’re also rather happy you took some time out to read by far the most eggs-citing part of the Site. However, we really do need to make sure you are aware of the legal stuff which is important so here we go!

Let’s start with the key part: by visiting this Site, using its functions and engaging with its content, you are accepting these terms of use, effective from the date you first visit us, or access this Site.

“Content” means all content on the Site, including all information, graphics, trade marks, logos, designs, text, photos, films, sounds, software and applications;

“Contribution(s)” means anything that a user sends to the Site, to The Big Egg Hunt office, to Action for Children, to Elephant Family or images supplied for the WPO competition, including any photographs, video or audio clips, comments or posts or competition entries;

“Site” means any of the three websites listed at the top of this page, which are officially owned or controlled by the partners in The Big Egg Hunt, and from which a link has been created to these terms of use;

This Site and all the Content on it is owned by Action for Children (on behalf of the joint initiative – The Big Egg Hunt – with Elephant Family) or its licensors and content providers. All rights in the Content are reserved to their respective owners, unless expressly stated otherwise.

Any Contribution you send or post to this Site remains your property, but Action for Children or Elephant Family may use your Contribution as described under “Your Contributions” below. You may not use any Content on this Site unless it is expressly stated that you may do so. Your Contributions:

If you send or post any Contributions to this Site or to The Big Egg Hunt via the addresses of either partner organisation, you confirm that you are granting Action for Children and Elephant Family a perpetual (and irrevocable), royalty-free, worldwide, non-exclusive licence to use the material in your Contribution for any purpose in any media in any part of the world. This includes the right for Action for Children and Elephant Family to copy, edit, publish, grant sub-licences, and exercise all other copyright and publicity rights over the material. You also waive all ‘moral rights’ in the materials (you can find more about what ‘moral rights’ are described eloquently in the Copyright, Designs and Patents Act 1988).

If you do not wish to grant us these rights, please do not send or post your Contribution to this Site or to The Big Egg Hunt, Action for Children or Elephant Family.

You must not post or send any material or information to this Site or any associated Big Egg Hunt partner that you do not have permission to use, for example clips of the artists or Eggs from TV shows. By sending or posting a Contribution to this Site or Action for Children or Elephant Family you warrant that:

  • your Contribution does not infringe any person’s intellectual property rights, which include any copyright, moral rights or trade mark rights;
  • you have all the necessary rights to post or submit the Contribution and to grant us the rights described in the these terms of use; and

Action for Children and Elephant Family do not endorse any Contribution or any opinion, statement, or advice expressed by users of this Site. To the fullest extent permitted by law, Action for Children and Elephant Family expressly disclaim all liability in connection with any Contributions made by users of this Site.

Unlawful use:

You may only use this Site for lawful purposes and you agree to comply with all applicable laws, regulations and codes of conduct and to be solely responsible for all things arising from your use of this Site. Registration and passwords:

If you register with us to collect Eggs using your Facebook ID or you register to take part in the online Auction, you agree:

  • to keep your password secure and confidential and not allow anyone else to use your email address or password to access this Site;
  • to notify Action for Children or Elephant Family (at the addresses listed below or to through the contact form on www.thebigegghunt.co.uk) immediately if you become aware of any improper or unauthorised use of this Site or your details or your password;
  • not to do anything which would assist anyone who is not a registered user to gain access to any password-protected area of this Site; and
  • not to create additional registration accounts for the purpose of abusing the functionality of the Site, or other users, or to seek to pass yourself off as another user.

Limitation Of Liability:

All software or services provided by third parties (for example Acrobat Reader, Facebook, twitter and Sensible Development (Auction service) are the sole responsibility of that third party provider.

Indemnity

You agree to indemnify Action for Children and Elephant Family (and their group companies, officers, trustees, employees and agents) from all claims, loss, damages, costs and expenses arising in connection with your use of this Site, or your breach of any of these terms of use, or any Contribution made by you (or through your account) on this Site. This obligation shall survive the end of these terms of use and your use of this Site.

General provisions:

If any provision of these terms of use is deemed to be invalid by a court of competent jurisdiction, this shall not affect the validity of the remaining provisions, which shall remain in full force and effect. Any failure or delay by Action for Children or Elephant Family in asserting any of their rights or of any provision of these terms of use shall not constitute a waiver of such right or provision. Action for Children and Elephant Family reserve the right at their discretion to discontinue or amend any aspect of the Site at any time.

Governing Law and Jurisdiction:

These terms of use shall be governed by and construed in accordance with English Law and you agree to submit to the exclusive jurisdiction of the English courts. This Site is controlled from within the United Kingdom.

Action for Children makes no representations that this Site is appropriate or available to locations outside the United Kingdom.

If you access this Site from outside the United Kingdom, you do so at your own risk and are responsible for compliance with applicable local laws or regulations.

Competition entries via SMS, donations and Auction bids:

There are a number of ways you can contribute to the work of Action for Children and Elephant Family – you can enter the text competition, donate via the Site and of course win one of the Eggs on the Auction.

Please be aware that donations and Auction payments are non-refundable. Payments for entries into the text competition are managed via the terms for that competition which you can find here. In exceptional situations for instance if there was an error processing your payment we may be able to refund a donation or Auction payment. However, all refunds are at the sole discretion of the Action for Children Trustees, and we reserve the right to charge an administration fee should we need to.

This Site is owned and operated by Action for Children on behalf of The Big Egg Hunt, which is a joint initiative between Action for Children and Elephant Family.
